Sworn translation and certified translation: what's the difference?

The main difference is that certified translations do not have legal validity because they are not sworn before the court, whereas sworn translations are necessary for documents whose legal validity must also apply to the translated version.

What is a sworn translation?

Sworn translation (in Italian: "asseverazione") is the official procedure provided for by Italian law which certifies the legal validity of a translation.
These translations are authenticated and made official by an oath report, which is written and signed by the professional translator.
Sworn translations are generally required for legal and corporate documents, notarial deeds, public certificates, criminal records and academic certificates, to certify compliance with the original.
 
Studio ATI has extensive experience in sworn translations and has been working with the Court Registry, Justice of the Peace and Public Prosecutor's Office for a number of years, completing all the necessary sworn translation and legalisation procedures.

Legalisation: what is it and when is it needed?

Legalisation is not to be confused with legal translation, which simply refers to the translation of legal documents; legalised translation is very often used as a synonym for sworn translation.

 

In actual fact, "legalisation/Apostille" involves authenticating the signatures on an official document. In the case of sworn translations, the signatures on the oath report are authenticated (the oath report is attached to the translation when it is sworn before the court).

Legalisation is only necessary in certain circumstances and only if the translated documents are for use abroad, generally outside the EU. Most countries adhere to the Hague Convention of 1961, meaning that legalisation is completed through an Apostille and the translated document becomes legally valid. In other countries, the final stage of the legalisation process must be completed at the consulate or embassy in Italy of the country where the translated document is required.
